1. Definitions

The following terms are used throughout this document:

"Pensara," "we," "us," or "our" refers to Pensara, a retirement document organisation service operating at 64 Charoen Muang Road, Wat Ket, Chiang Mai 50000, Thailand.
"Service" means any session, course, programme, or associated materials provided by Pensara, including the Retirement Paperwork Checklist Session, the Pension Terms Made Simple Course, and the Long-Term Records Management Programme.
"User," "you," or "your" refers to any person who visits our website, makes an enquiry, or engages our services.
"Content" means all written materials, checklists, glossaries, guides, and other resources produced or shared by Pensara.
"Agreement" means these Terms & Conditions, together with any booking confirmation or service agreement between you and Pensara.
"Website" means the Pensara website accessible at pensaraj.biz.

2. Acceptance of Terms

By visiting this website, making an enquiry, or booking any Pensara service, you agree to be bound by these Terms & Conditions. If you do not agree, please refrain from using our website or services.

To use our services, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. Services booked on behalf of another person (such as a family member) must still be arranged by an adult.

These Terms may be updated from time to time. The version displayed on this page at the time of your booking applies to that booking.

3. Service Description

Pensara provides educational and organisational services related to retirement paperwork and household records. Our three current offerings are:

Retirement Paperwork Checklist Session — a one-to-one walkthrough that helps you understand what retirement documents you have, what may be missing, and how to create a simple personal checklist.
Pension Terms Made Simple Course — a structured educational session covering common pension vocabulary, processes, and document types, delivered in plain language with supporting materials.
Long-Term Records Management Programme — a multi-session programme that helps you build a lasting system for storing, updating, and communicating household and retirement records.

All services are strictly informational and organisational in nature. Pensara does not provide financial advice, legal advice, investment recommendations, or licensed professional services of any kind.

Services are delivered in Chiang Mai, Thailand. Remote delivery (video call) may be available by arrangement. Pensara reserves the right to modify service formats or availability with reasonable notice.

4. User Responsibilities

When using the Pensara website or services, you agree to:

Provide accurate and complete information when making an enquiry or booking.
Attend scheduled sessions at the agreed time, or give at least 48 hours' notice if you need to reschedule.
Use any materials, checklists, or guides provided by Pensara for personal, non-commercial purposes only.
Not reproduce, distribute, or share Pensara content without prior written permission.
Treat Pensara staff with courtesy and respect at all times.
Not use the website to submit false, misleading, or harmful information.

You are responsible for any decisions you make based on information discussed during Pensara sessions. We encourage you to seek appropriate licensed advice (legal, financial, or otherwise) for decisions that go beyond organisational and informational matters.

5. Intellectual Property

All content produced by Pensara — including session materials, checklists, glossaries, guides, course notes, and website content — remains the intellectual property of Pensara unless expressly stated otherwise.

You are granted a limited, non-exclusive, non-transferable licence to use materials provided to you during a session or course for your own personal use. This licence does not permit you to:

Copy, distribute, or share materials with others for commercial gain.
Modify or adapt materials and present them as your own.
Use materials in training, publications, or presentations without written permission from Pensara.

Materials shared with Pensara during sessions (such as your own documents brought for organisational purposes) remain your property. Pensara will not retain copies without your consent.

6. Payment & Fees

6.1 Pricing

All prices are quoted in Thai Baht (฿) and are inclusive of any applicable taxes unless otherwise stated. Current service prices are:

Retirement Paperwork Checklist Session — ฿4,000
Pension Terms Made Simple Course — ฿16,500
Long-Term Records Management Programme — ฿33,500

Pensara reserves the right to adjust pricing. The price confirmed at the time of booking applies to that booking.

6.2 Payment

Payment terms will be confirmed at the time of booking. We accept payment by bank transfer or cash. Full payment is typically required in advance of the first session unless a payment schedule is separately agreed in writing.

6.3 Refunds & Cancellations

Cancellations made at least 48 hours before a scheduled session will receive a full refund or the option to reschedule. Cancellations made with less than 48 hours' notice may be subject to a partial cancellation fee equivalent to one session's cost where the programme spans multiple sessions. No-shows are non-refundable. In the event Pensara must cancel a session, you will be offered a full refund or an alternative date.

7. Service-Specific Terms

7.1 Checklist Session

The Retirement Paperwork Checklist Session is delivered as a single focused meeting. It results in a personalised checklist for your own use. The session does not constitute advice of any kind and does not assess the adequacy or suitability of your retirement arrangements.

7.2 Pension Terms Course

The Pension Terms Made Simple Course is educational in nature. Completion does not confer any qualification or certification. A printed or digital glossary is included for your personal reference. The course content is general and does not relate to the specifics of any individual's pension arrangements.

7.3 Records Management Programme

The Long-Term Records Management Programme is delivered across multiple sessions. A schedule will be agreed at the outset. Pensara will confirm in writing the number of sessions included and any follow-up arrangements. Changes to the programme scope must be agreed in writing by both parties.

8. Disclaimers

Pensara services are provided for educational and organisational purposes only. We do not hold any licence to provide financial, legal, medical, or investment advice, and nothing shared in our sessions or materials should be understood as such.

We do not make any representation that the information in our sessions will be suitable for your particular circumstances. We do not promise specific outcomes or results from the use of our services.

Our website and materials are provided "as is." We take reasonable care to ensure accuracy but do not warrant that all information is error-free or completely up to date. External documents, regulations, and pension rules may change; users should verify current information through official sources.

9. Limitation of Liability

To the fullest extent permitted by Thai law, Pensara's total liability to you arising from or in connection with these Terms or our services shall not exceed the total amount paid by you for the specific service in question.

Pensara shall not be liable for:

Indirect, incidental, or consequential loss.
Loss of income, savings, investment returns, or expected benefits.
Decisions made by you based on information discussed during sessions.
Errors or omissions in third-party documents, regulations, or pension schemes.

Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud or wilful misconduct.

10. Indemnification

You agree to indemnify and hold harmless Pensara, its staff, and associates from any claims, losses, or expenses (including reasonable legal costs) arising from:

Your breach of these Terms.
Misuse of materials or information provided by Pensara.
Any false or misleading information you provided to Pensara.

11. Termination

Either party may end a service arrangement by giving written notice. If you wish to withdraw from a programme part-way through, refunds will be calculated based on the number of sessions completed, minus any applicable cancellation fee per clause 6.3.

Pensara may decline to continue a service relationship if a user engages in behaviour that is disrespectful, disruptive, or in breach of these Terms. In such cases, a proportionate refund for unused sessions will be offered.

Clauses 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Dispute Resolution) survive termination.

12. Dispute Resolution

These Terms are governed by the laws of Thailand. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.

Before initiating formal proceedings, both parties agree to make a genuine effort to resolve any disagreement through direct, good-faith communication. Please contact us at [email protected] in the first instance.

If direct resolution is not achieved within 30 days, the parties may agree to seek mediation through a mutually acceptable mediator before pursuing court proceedings.

13. General Provisions

Entire Agreement: These Terms, together with any written booking confirmation, represent the full agreement between you and Pensara regarding the relevant service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Failure by Pensara to enforce any provision of these Terms on a given occasion does not constitute a waiver of that provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Language: These Terms are written in English. In the event of any translation, the English version shall prevail.

14. Changes to These Terms

Pensara may revise these Terms periodically to reflect changes in our services, operating practices, or applicable law. When we make material changes, we will update the "Last Updated" date at the top of this page.

Continued use of our website or services after changes are published constitutes your acceptance of the revised Terms. If you have an active booking, changes will not affect that booking retroactively.
